These Terms of Use govern your access to and use of soteryan.com (the “Website”). The Website is operated by Soteryan BV (Tweede Jacob van Campenstraat 118-H, 1073XX Amsterdam, the Netherlands; KvK 62621726). By accessing or using the Website, you accept and agree to be bound by these Terms. If you do not agree, please do not use the Website. These Terms apply to your use of the public marketing website only; commercial engagements with Soteryan are governed by separately signed contracts.

1. Eligibility

You may use the Website if you are at least 16 years of age and able to enter into a legally binding agreement under the laws of your jurisdiction. By using the Website you represent that you meet these requirements.

2. Permitted use

Soteryan grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Website for your own personal or internal business purposes — namely, to learn about Soteryan, our products and services, and to contact us. Any other use requires our prior written permission.

3. Prohibited use

You agree not to:

• Use the Website in any way that violates applicable national, EU, or international law, or infringes the rights of any third party.
• Engage in unauthorised access, scanning, probing, or testing of the Website’s vulnerabilities, except in accordance with our coordinated-disclosure process described in /.well-known/security.txt.
• Interfere with the proper functioning of the Website, including by introducing malware, denial-of-service activity, automated scraping at a rate that disrupts service, or by circumventing any security or rate-limiting measure.
• Reverse-engineer, decompile, or attempt to derive the source code of any part of the Website (other than the publicly served HTML/CSS/JS).
• Use the Website to harvest contact information, send unsolicited communications, impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Frame, mirror, or otherwise re-publish substantial parts of the Website without our prior written permission.

4. Account-free access

No account is required to use the Website. The contact form and the newsletter sign-up collect personal data; how that data is processed is described in our Privacy Policy. Submitting either form is voluntary; you may always contact us by email instead.

All content on the Website — including text, graphics, brand marks (Soteryan, BreachShield, FraudShield, DNSShield, Fraud SDK), logos, layout, design, and source code — is owned by or licensed to Soteryan BV and protected by Dutch and international intellectual-property laws. Subject to your compliance with these Terms, you may view, download, and print pages from the Website for your own personal or internal business reference, provided you do not modify them and you preserve all copyright and proprietary notices.

Any other use — including reproduction, distribution, public performance, modification, derivative works, or commercial exploitation — requires our prior written permission. References to third-party trademarks remain the property of their respective owners and are used here only for descriptive or comparative purposes; no affiliation or endorsement is implied unless explicitly stated.

6. Feedback

If you provide feedback, suggestions, or improvement ideas about the Website or any Soteryan product or service, you grant Soteryan a perpetual, irrevocable, royalty-free, worldwide licence to use that feedback for any purpose, without obligation or compensation to you. Feedback is provided “as is” and without warranty.

7. Availability & changes

We may modify, suspend, or discontinue any part of the Website at any time, with or without notice. We do not warrant that the Website will be available at all times or be free of errors. We may update these Terms from time to time; the “Last updated” date at the top of this page indicates when they were last revised. Material changes will be flagged on the Website. Your continued use of the Website after changes take effect constitutes your acceptance of the revised Terms.

8. Disclaimer of warranties

9. Limitation of liability

To the maximum extent permitted by law, Soteryan BV, its directors, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or in connection with your access to or use of the Website. Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, death or personal injury caused by our negligence, or any other liability that cannot be excluded under Dutch law.

10. Indemnification

To the extent permitted by law, you agree to indemnify and hold Soteryan harmless from any third-party claim, demand, loss, or damage (including reasonable legal fees) arising from your unlawful or unauthorised use of the Website or your breach of these Terms.

11. Privacy

Use of the Website is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference.

12. Governing law & jurisdiction

These Terms are governed by the laws of the Netherlands, excluding its conflict-of-law principles. Any dispute arising out of or in connection with these Terms or your use of the Website shall be brought before the District Court of Amsterdam (Rechtbank Amsterdam), unless mandatory consumer-protection law assigns jurisdiction to your place of residence.

13. Severability & entire agreement

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision shall be replaced with one that comes closest to its intent and is enforceable. These Terms, together with the Privacy Policy, Cookie Policy, Disclaimer, and Legal Notice, constitute the entire agreement between you and Soteryan regarding your use of the Website.
